Terms of Use

By using GOONMASTER (the "Service"), you agree to these Terms of Use and our Privacy Policy. The Service is intended for adults 18 years or older. Use of the Service confirms your age.

When you create an account, you are asked to expressly confirm that you have read and accept these Terms of Use and the Privacy Policy before registration completes. An account cannot be created without that acceptance, and we record the date and time of it. Using the Service without an account (for example the free Gooning mode) equally constitutes acceptance of these Terms.

The Service is operated by Dopateq Kamil Lach ("we", "us"), a sole proprietorship registered in Poland (NIP 9581765529, REGON 544949243), with its registered business address at al. Solidarności 68/121, 00-240 Warszawa, Poland.

If you do not agree or are under 18, you must immediately stop using the Service.

GOONMASTER is an adult-utility web application: a smart BPM metronome, modular audio overlay system, and a client-only media player that loads files from the user's own device. The platform is interactive utility software, not a content host.

• Smart metronome with adaptive BPM curves across multiple game modes (Gooning, Progression, Daily/Weekly Challenges)
• AI voice instruction overlay, paced to the metronome (toggleable) — every voice is fully synthetic, AI-generated audio; see the AI Voice Disclosure below
• Bring-your-own-content media player — loaded files play in your browser only; nothing uploads to our servers — plus Companion mode, which pairs the audio HUD with any external tab
• Progression system with 10 ranks (Goonbie → Goonmaster), 100 levels total, free chapters 1-5 + Premium chapters 6-10
• Premium subscription tiers (monthly, quarterly, yearly, limited launch lifetime) processed via SegPay (cards) or NOWPayments (cryptocurrency)

GOONMASTER does not host, store, transcode, or distribute any visual adult content. All visual media played in the app is supplied by the user from their own local files and remains entirely on the user's device.

• Provide accurate information and maintain account confidentiality
• Users must be 18+ to create an account
• One account per person; multiple accounts may be suspended
• Use strong passwords and follow security best practices

You are responsible for all activity under your account. Report unauthorized access immediately to support@goonmaster.io.

What the Platform Provides

• The application itself: metronome engine, audio overlays, game modes, ranks, UI, and copy.
• Audio packs created by GOONMASTER (metronome ticks and voice clips) that play locally during sessions.
• Your account data, gameplay progress, rank/XP, and subscription state — stored to operate the service.
• Visual media: NONE. All visual content played in the app is loaded by you from your own device.

What You Must Not Load Into the Media Player

• Any content depicting or appearing to depict minors (under 18).
• Non-consensual content, intimate images of identifiable individuals without their consent, or non-consensual deepfakes.
• Illegal material — including CSAM (child sexual abuse material), terrorist content, or material that violates the laws of your jurisdiction.
• Content used to harass, defame, or threaten an identifiable individual.

Prohibited Behavior on the Platform

• Bypassing premium gating, payment systems, age verification, or attempting unauthorized access.
• Distributing malware, malicious links, or phishing material via account fields (username, bio, etc.).
• Sharing, selling, or leasing your account credentials or active subscription.
• Automated scraping or other commercial misuse of the service.

NCII (Non-Consensual Intimate Content) Notice

Because GOONMASTER does not host or store visual content, NCII can only enter the platform through (a) account-field abuse (username, bio) or (b) external links shared by users in support correspondence. If you discover NCII referencing you in either context, report immediately to support@goonmaster.io. We review high-priority reports (illegal content, NCII) within 24 hours.

We reserve the right to suspend or terminate accounts that violate these policies regardless of whether the violating content was ever stored on our servers. Repeated violations result in permanent termination.

• No harassment, hate speech, discrimination, or abusive behavior
• No system interference, unauthorized access, hacking attempts, or bot usage
• No impersonation, false information, or fraudulent activity
• No solicitation of prostitution, sexual services, or illegal activities
• No commercial misuse or unauthorized data scraping

Violations may result in immediate account suspension or termination without refund.

GOONMASTER's platform, code, features, branding, and marks are owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws.

• By using the Service, you grant us a non-exclusive license to display, process, and store your account data and preferences as necessary to operate the platform
• You may not copy, modify, distribute, sell, or reverse engineer any part of the Service
• Copyright holders may report infringement to dmca@goonmaster.io

DMCA Compliance

We comply with the Digital Millennium Copyright Act (DMCA). To submit a takedown notice, email dmca@goonmaster.io with: (1) Description of copyrighted work, (2) Location of infringing material (URL), (3) Your contact information, (4) Good faith statement, (5) Statement of accuracy under penalty of perjury, (6) Physical or electronic signature.

Ownership of Platform Assets

GOONMASTER owns the application itself (source code, UI, branding, copy) and any audio packs (metronome ticks and voice clips) produced and shipped by GOONMASTER. Visual content is NEVER produced or hosted by the platform — see the Platform Overview section.

Your Rights:

• Use the application under the rights granted by your account / subscription.
• Load your own legally-obtained media files into the in-browser player.
• NOT redistribute, sell, license, or reverse-engineer the application code, UI, branding, or audio packs.
• NOT extract or rehost GOONMASTER's audio assets outside the application.
• Retain full ownership of any media you load — we acquire no rights to it because we never receive it.

User gameplay data (progression, preferences, subscription state) is stored to operate the Service and remains associated with your account. This data is governed by our Privacy Policy.

AI Voice Disclosure

All voice instructions on GOONMASTER are fully synthetic, AI-generated audio. The voice personas were designed from text descriptions using generative voice-synthesis software; they are not recordings or clones of, and are not derived from, any real, identifiable person, and no voice performers were employed in their production.

We provide this disclosure in accordance with the transparency obligations of Article 50 of the EU AI Act (Regulation (EU) 2024/1689) and analogous AI-disclosure laws. The synthetic nature of the voices is also disclosed in the application itself and in our 18 U.S.C. § 2257 statement. The AI voices are an audio-only guidance feature: GOONMASTER does not use AI to generate any visual content.

Unauthorized redistribution of GOONMASTER application assets or audio packs may result in account termination and legal action.

18 U.S.C. § 2257 — Not Applicable

GOONMASTER is exempt from 18 U.S.C. § 2257 record-keeping requirements because the platform does not produce, host, distribute, or otherwise act as a "secondary producer" of any visual depictions of actual sexually explicit conduct.

• The platform hosts no visual content of any kind. The in-app media player loads files from the user's own local device; nothing uploads to GOONMASTER's servers.
• Audio assets (metronome ticks and voice clips) are not visual depictions and fall outside § 2257.
• GOONMASTER does not commission, license, ingest, transcode, or store visual content created by any third party.
• Because no visual content is produced or held by GOONMASTER, no performer records exist or are required to be maintained.

If you believe any account, link, or correspondence on this platform misuses content depicting you, report it immediately to records@goonmaster.io or {dmcaContact}.

The 2257 framework applies to producers and secondary producers of visual depictions. GOONMASTER is neither. Users are individually responsible for the legality of any content they load into the in-browser media player.

GOONMASTER offers a free tier and a Premium subscription with four billing options. Card payments are processed via SegPay; cryptocurrency payments are processed via NOWPayments. The terms and privacy policy of whichever processor you use also apply to your transaction.

• Free tier: Gooning mode, Progression chapters 1-5 (50 levels), standard Daily and Weekly challenges, the bring-your-own-content media player (up to 4 clips), the smart metronome with its default sound, and AI voice guidance via the free voice pack (Brandi). Gooning is playable without an account; a free account is required for Progression, the Daily/Weekly challenges, and to keep your progress across devices.
• Premium Monthly: $9.99 / 30 days, auto-renews until cancelled.
• Premium Quarterly: $24.99 / 90 days, auto-renews until cancelled. ~17% saving vs monthly.
• Premium Yearly: $49.99 / 365 days, auto-renews until cancelled. ~58% saving vs monthly.
• Premium Lifetime: $99 one-time charge. No renewal. Available only during the launch window — once the window closes, only the recurring plans remain.
• All plans unlock the same content: the Scarlett, Chloe and Sara voice packs, split-screen multi-view, a 100-clip playlist, Stamina Mode, Progression chapters 6-10 (Goonmaxxer → Goonmaster) including the Goonmaster rank path, Finale Mastery capstones, the Daily Pro and Weekly Pro variants, Streak Freeze, and the premium metronome sounds.
• Payment methods: Major credit/debit cards via SegPay (Visa, Mastercard, American Express, Discover), or cryptocurrency via NOWPayments. Both options are available at launch.
• Crypto payments via NOWPayments are one-time charges that grant Premium for the selected plan's duration (30 / 90 / 365 days, or lifetime). They do not auto-renew — access ends when the period lapses unless you purchase again.
• We do not store payment card details. SegPay handles all card data under PCI-DSS compliance.
• Card charges appear on your statement under the discreet billing descriptor SEGPAY.COM*DOPATEQ. It will not include the word GOONMASTER.
• Recurring subscriptions can be cancelled any time from your account settings or directly through SegPay (self-service portal at cs.segpay.com, cs@segpay.com, +1 866-450-4000). Cancellation stops the next renewal — you retain Premium access through the end of the period you already paid for.
• The Lifetime plan is a single charge with no renewal to cancel.

We may modify pricing, features, or discontinue services with 30 days' notice. Existing recurring subscriptions are honored at their original rate until renewal. The Lifetime plan, once purchased, remains valid for the lifetime of your account regardless of future pricing changes. Service availability is not guaranteed but we operate to a best-effort uptime standard.

Refund Policy

We want you to be satisfied with your purchase. Our refund policy is designed to be fair while complying with applicable laws. Free Tier / Account Deletion

Free accounts have no charges and require no refunds. If you delete your account within 24 hours of creation, no payment is collected.

Subscription Cancellation

• You may cancel your subscription anytime from your account settings
• Cancellation takes effect at the end of your current billing period (no immediate refund)
• You retain access to premium features until the period ends
• No refunds for partial months unless required by law or due to service failure
• Crypto payments (via NOWPayments) are one-time charges that never auto-renew, and on-chain transactions cannot be reversed; approved crypto refund cases are handled as service credit or an equivalent crypto refund per the Refund & Cancellation Policy

Legal Refund Rights

EU/UK Users - Digital Content Exception: Under EU Consumer Rights Directive Article 16(m), you waive your 14-day cooling-off period when you: (1) Request immediate access to digital content, AND (2) Give express consent acknowledging loss of withdrawal rights. By clicking 'Purchase Premium' and accessing premium features, you provide this express consent. You may still request refunds for technical issues that prevent service access (evaluated case-by-case).

California Users (CCPA): Pro-rata refunds for unused subscription time if service is not provided as promised or if you experience technical issues preventing access.

All Users: Refunds for technical issues preventing service access (evaluated case-by-case at our discretion).

How to Request a Refund

• Email support@goonmaster.io with your account email, purchase date, and reason
• Include documentation of any technical issues (screenshots, error messages)
• We will respond within 5-7 business days
• Approved refunds are processed within 7-10 business days to your original payment method

No Refunds For

• Account termination due to Terms violations.
• Voluntary account deletion after using premium features.
• "Changed my mind" after beginning use of premium features (withdrawal right waived per Article 16m for EU/UK users who consented to immediate access).
• Subjective dissatisfaction with audio packs, BPM curves, level pacing, or other GOONMASTER design decisions.
• Failure to use the service during your subscription period.
• The Lifetime plan after Premium features have been accessed (waived withdrawal as above).

• We collect only necessary data for the Service (email, username, preferences)
• No tracking of external websites or cross-site profiling
• Enhanced privacy for adult content usage (encrypted data, strict access controls)
• Users can request data export or deletion at any time from account settings

Accounts may be terminated by users or by GOONMASTER for violations of these Terms, illegal activity, or fraudulent behavior.

• User-initiated deletion: Account deleted immediately. Financial records retained as required by law.
• Platform-initiated termination: Access suspended immediately. Data retained as necessary for legal compliance.
• Premium subscriptions end immediately upon termination with no refund for Terms violations
• You may export your data before account deletion (available in account settings)

Platform-initiated terminated users may not create new accounts without our explicit permission.

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

• No warranty of uninterrupted service, error-free operation, or specific results
• No liability for indirect, incidental, consequential, or punitive damages
• No responsibility for user-generated content or external links
• No liability for security breaches beyond our reasonable control
• Users assume all risks related to adult content usage
• Maximum liability limited to amount paid in the 12 months prior to the claim

Force majeure applies to events beyond our reasonable control (natural disasters, wars, pandemics, government actions, infrastructure failures).

Dispute Resolution & Governing Law

Governing Law

These Terms are governed by the laws of Poland (as platform operator location), without regard to conflict of law principles. For users outside the EU, the UN Convention on Contracts for the International Sale of Goods does not apply.

Step 1: Informal Resolution

Before filing any legal claim, you agree to contact support@goonmaster.io and attempt to resolve the dispute informally for 30 days. Most disputes can be resolved through direct communication.

Step 2: Arbitration (Optional)

If informal resolution fails, disputes may be resolved through binding arbitration under the rules of the Court of Arbitration at the Polish Chamber of Commerce in Warsaw. Arbitration shall be conducted in English in Warsaw, Poland.

Exceptions to arbitration:

• Claims for injunctive relief or urgent interim measures
• Intellectual property disputes (copyright, trademark infringement)
• Small claims court matters (under 20,000 PLN / $5,000 USD)
• Claims related to illegal content (CSAM, NCII, violence)

Step 3: Court Jurisdiction

If arbitration is waived or unavailable, you agree that any legal action must be brought in the courts of Warsaw, Poland. You consent to personal jurisdiction and venue in these courts.

Class Action Waiver

You agree to bring claims against GOONMASTER only in your individual capacity, not as part of any class action, collective action, or representative proceeding. This waiver does not apply if your jurisdiction prohibits class action waivers.

EU Consumer Rights

Nothing in this section limits your rights as an EU consumer under mandatory EU consumer protection laws, including the right to bring proceedings in your country of residence.

We may update these Terms from time to time. Material changes will be announced via email or in-app notification at least 30 days in advance. Continued use after changes indicates acceptance.
